베트남 노동허가서 (Working Permit) 신청서류

베트남에 불법으로 사는 사람들이 많은지 이제는 노동허가서를 전부 받으라고 합니다.

예전에도 이런 법률 규정은 있었으나 잘 지키지 않았는데, 베트남 정부에서 칼을 뽑아들은거 같습니다.

뭐 저같은 민초들이야 시키는대로 해야죠.

신청서류를 다음과 같이준비해서 노동국에 신청하면 됩니다.

신청서류 (1) 기업(사용자)      ① 고용허가서 발급신청서      ② 외국인 근로자 사용 허가  (동 서식은 성ㆍ시 노동국에서 구입하셔야 합니다)     (2) 근로자 (아래 서류 2세트를 구비해야 함)      ① 고용신청서(08/2008/TT-BLDTBXH 첨부된 제1호 서식)          ※ 한국기업이 자사 근로자를 베트남 법인에 파견하는 경우 동 신청서를 작성하지 않아도 되며, 이    에 대신하여 파견한 한국 모기업의 파견 발령증을 첨부하면 됨      ② 한국 경찰청에서 발행한 범죄경력증명서           - 아울러, 해당 근로자가 베트남에 거주한지 6개월이 경과한 경우 베트남내 거주지 해당 사법국의             신원조회서 발급받아야 함       ③ 이력서(08/2008/TT-BLDTBXH 첨부된 제2호 서식)       ④ 한국에서 발급한 건강증명서 또는 근로자가 베트남에 거주하는 경우 보건부 규정에 부합하는 건강         증명서      ⑤ 직무에 부합하는 경력 및 자격증 사본         -  학사, 석사, 박사 등 학위 사본 또는 자격증 사본, 5년이상 동일직종에 근무한 경력증명서 등      ⑥ 칼라 증명사진(3cmx4cm) (3장)    고용허가 발급     관할 노동국은 적법한 서류를 모두 받은 날로부터 15일 이내에 고용허가를 발급하도록 되어 있습니다.   고용허가관련 수수료      (1) 최초의 고용허가 : VND400,000       (2) 고용허가 재발급 : VND300,000       (3) 고용허가 연장 : VND200,000

아래는 영문으로 되어있는 신청관련 양식입니다.

때에 따라서 베트남 직원들에게 설명할때는 영문으로 되어있는것이 효과적이죠. 

내용은 한글로 되어있는 내역과 대동소이합니다.

2. Foreigner’s employment application: The foreigner submits 02(two) copies of the employment application to the employer, of which one copy is kept by the employer  and the other given to the laborer to complete registration procedures for the issuance of a labor permit. Each employment application consists of:   a) Foreigner’s employment application registration form in the standardized form stipulated by Ministry of Labor, War Invalids and Social Affairs   b) A personal criminal record issued by the competent authority of the country where a foreigner resides before arriving in Vietnam. If the foreigner who has been residing in Vietnam for a full period of 6 months and over, only a personal criminal record issued by the Vietnamese Department of Justice in the locality where the foreigner resides is required;   c) A foreigner’s self-declared curriculum vitae in the standardized form stipulated by the Ministry of Labor, War Invalids and Social Affairs;   d) A Health Certificate issued in a foreign country or a Health Certificate issued in Vietnam in accordance with the regulations of Vietnam’s Ministry of Health;   e) A copy of a foreigner’s certificate of high professional and technical competence. If a foreigner who is an artisan of a traditional craft or who has experience in his trade, in production operation and management does not hold any certificate or degree of recognition, there must be a letter of confirmation of at least 5-year experience in a trade or in production operation and management made by the foreign competent authority;   f) 03 color 3cm x 4cm photos with unhatted head, front and clear face, clear ears, no glasses on a white background. The photos must be taken no later than 06 months from the day a foreigner submits his application; 3. The documents stipulated in the above-mentioned application must be issued by a foreign competent agency or organization or be notarized or certified and undergo consular authentication according to the regulations and laws of Vietnam and be translated into Vietnamese. The translation and copies must be notarized according to the regulations and laws of Vietnam.
